Terms of Service

These Terms are the agreement between you and GoochieGoo LLC for the use of GoochieGoo. They are written to be read, not to be survived. Please do read section 5, which is about what GoochieGoo is not, and sections 13 and 14, which limit what we are responsible for.
1. Accepting These Terms
By creating a GoochieGoo account, or by using the app, you agree to these Terms. If you do not agree, please do not use GoochieGoo.
If we change these Terms in a way that matters, we will tell you in the app before the change takes effect, and update the date at the top. Continuing to use GoochieGoo after that means you accept the new version.
2. Who May Use GoochieGoo
You must be at least 18 years old, and you must be the parent or legal guardian of any baby whose profile you create. GoochieGoo is for adults; it is not directed to children and children may not use it.
By creating a baby's profile you confirm that you have the authority to provide that child's information and to make decisions about it.
3. Your Account
The account is yours to keep secure. Use a password you do not use elsewhere, and tell us at hello@goochiegoo.app if you think someone else has access to it.
You are responsible for what happens under your account, including what the people you invite into your Village do with the access you give them.
4. What GoochieGoo Does
GoochieGoo lets you log feeds, sleep, diapers and milestones, keep your baby's profile and photos, share the record with the caregivers you choose, and receive everyday guidance and reminders from Goochie.
We may add, change or remove features. If we remove something you rely on, we will give you notice where we reasonably can.
5. GoochieGoo Is Not Medical Advice
This is the most important section in this document.
GoochieGoo and Goochie give general, everyday information to support you as you care for your baby. Nothing in the app diagnoses a condition, treats an illness, or tells you what medication to give. GoochieGoo is not a medical device, and it is not a substitute for the judgment of your pediatrician, who knows your baby's history and can examine them directly.
Guidance in the app is general and based on your baby's age and the records you enter. It cannot know what a clinician would know. If your instinct and the app disagree, follow your instinct and call your pediatrician.
6. Your Content Stays Yours
The photos, logs, notes and captions you add are yours. We do not claim ownership of any of it.
You give us a limited licence to store, copy and display that content, solely so that we can operate GoochieGoo for you and for the caregivers you have shared it with. That licence exists only to run the service, it is not transferable to anyone else, and it ends when you delete the content or your account.
You confirm that you have the right to upload what you upload, including any photograph containing another person.
7. Using GoochieGoo Fairly
Please do not:
- Use GoochieGoo for anyone whose parent or guardian you are not.
- Upload anything unlawful, or any image of a child you do not have the right to upload.
- Try to access another family's data, probe the service for weaknesses, or interfere with how it works.
- Scrape, resell or redistribute the app, or use it to build a competing product.
- Use automated systems to create accounts or generate load.
We can suspend or close an account that does any of these, or that puts other families at risk. Where the situation allows it, we will tell you first.
8. Your Village
Inviting someone into your Village lets them see and add to the records you share, within the permissions you set. You decide who is invited and you can remove them at any time, which ends their access immediately.
You are responsible for who you invite. We cannot undo what a person you invited has already seen.
9. Notifications
Reminders and nudges are sent only if you turn them on, and you can turn them off in the app or in your device settings. They are a convenience, not a guarantee: a notification can be delayed or lost by your device, your network, or Apple's and Google's delivery systems. Do not rely on GoochieGoo as the only reminder for anything that matters medically.
10. Price
GoochieGoo is free to use at launch. If we introduce a paid plan, we will say clearly what is included, what it costs, and what happens to the features you already use, before you are asked to pay for anything.
11. The App Stores
You get GoochieGoo through Apple's App Store or Google Play, and their terms apply alongside these.
For the App Store specifically: this agreement is between you and GoochieGoo LLC only, not with Apple, and Apple is not responsible for GoochieGoo or its content. Apple has no obligation to provide support for the app. If the app fails to conform to any warranty, you may tell Apple and Apple will refund the purchase price, if any; beyond that, Apple has no other warranty obligation. GoochieGoo LLC is responsible for any product liability claim, any claim that the app infringes intellectual property, and any claim under consumer protection law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Ending Your Account
You can delete your account at any time from Settings, then Account, then Delete account. Deletion is permanent and removes your family's records as described in the Privacy Policy.
We may suspend or end your access if you break these Terms, if we are required to by law, or if we stop offering GoochieGoo. If we discontinue the service, we will give you reasonable notice and a way to export your records first.
13. No Warranties
GoochieGoo is provided as it is and as it is available. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
We do not promise that the app will be uninterrupted, error-free, or that its guidance will suit your particular baby. Some places do not allow these exclusions, in which case they do not apply to you.
14. Limits on Our Liability
To the fullest extent the law allows, GoochieGoo LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or lost profits, arising out of your use of GoochieGoo.
Our total liability for any claim relating to GoochieGoo is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
15. Indemnity
You agree to cover our reasonable costs if a claim is brought against us because of your use of GoochieGoo in breach of these Terms, or because of content you uploaded that you did not have the right to upload.
16. Governing Law
These Terms are governed by the laws of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in California, and we each consent to those courts.
If you are a consumer in a place whose law gives you the right to bring a claim locally, this section does not take that right away.
17. Before You Sue Us
If something goes wrong, please email hello@goochiegoo.app first and give us 30 days to put it right. Most problems are faster to fix than to litigate, and we would rather fix them.
18. The Rest
If a court finds part of these Terms unenforceable, the rest stays in force. If we do not enforce something immediately, we have not given up the right to enforce it later. You may not transfer these Terms to anyone else; we may transfer them as part of a merger or sale of the business.
These Terms, together with the Privacy Policy, are the whole agreement between us about GoochieGoo.
